Abstract

This study examines how husbands and wives fulfil their rights and obligations in Indonesian migrant worker households in Ender Village, Cirebon Regency, from the perspective of maqashid syariah. The study used a qualitative descriptive-analytical case study. Data were collected through semi-structured interviews, observation, and documentation involving seven informants and were analysed using the Miles, Huberman, and Saldaña model based on the five essential elements of daruriyat. The findings show different levels of fulfilment across the five dimensions. Hifz al-mal was the most strongly fulfilled, followed by hifz al-din, while hifz al-nasl and hifz al-'aql were fulfilled adaptively. Hifz al-nafs was the most vulnerable dimension because emotional needs and direct companionship were difficult to replace through digital communication. The findings show that physical separation does not eliminate marital rights and obligations but changes the way they are fulfilled. The quality and continuity of communication appeared to be more important for maintaining marital relationships than the length of separation. The study concludes that maqashid syariah can accommodate the changing roles of husbands and wives in migrant worker households when adaptations are based on mutual agreement and continue to protect the essential purposes of family life.
